New post-Brexit regulations for Northern Ireland

The rules surrounding new product notifications for the Northern Ireland market have been finalised ahead of the 1 January 2021 Brexit transition date.

The Tobacco Products and Nicotine Inhaling Products (Amendment) (EU Exit) Regulations 2020 will change the way the Tobacco and Related Products Regulations 2016 apply across Great Britain and Northern Ireland following the end of the Brexit transition period.

There is concern that the new rules will see different regulatory environments for Northern Ireland and the rest of the United Kingdom. 

From 1 January 2021, notifications on the EU Common Entry Gate (EU-CEG) continue to apply to Northern Ireland while Great Britain moves to a new system created by the Medicines and Healthcare products Regulatory Agency (MHRA). Products going on sale in both Northern Ireland and Great Britain must notify on both the existing EU-CEG system and new MHRA system.

The Department of Health has said it is working closely with Public Health England and the MHRA to publish more detailed guidance which will be available soon.
